Course introduction

The purpose of the course is to enable the student to address the general requirements of environmental and administrative laws and to understand the premises of public authority actions concerning citizens and businesses. This understanding is essential both in relation to employment within relevant parts of the private sector and certain public authorities. The student is enabled to handle assignments about climate adaptation by the course providing knowledge of legislation and management within the field. 

Environmental law is a discipline within the group of special administrative laws. The course, therefore, includes basic knowledge of the administrative law, including the requirements for administrative management. 

The course is primarily based on Danish laws, including legislations, orders, and guidances, but EU law (e.g. directives) is included where it is particularly relevant. 

In relation to the competence profile of the degree, it is the explicit focus of the course to:
  • give knowledge of theory and practice in environmental law
  • give skills in identifying and analyzing theoretical and practical issues in the field of the environment and orally disseminating these
  • give the competence to work independently and deal with complex situations in environmental law and orally disseminate these for both educational and work situations.

Expected learning outcome

To achieve the purpose of the course, the learning objective of the course is that the student demonstrates the ability to: 
  • explain the EU directive e.g. the Water Framework Directive and Habitats Directive

  • Describe international agreements as the UN’s SDGs and the climate agreements such as the Paris agreement 
  • Explain national laws such as the Environmental Protection Act, the Nature Protection Act, the Planning Act, the Environmental Goals Act, and the Watercourse Act. 
  • Describe relevant orders such as the statutory order on waste water treatment.
  • Explain decisions of the Boards of Appeal. 
  • Explain other relevant writings from, for example, the Waste Water Committee. 
  • Describe legislation and management of xenobiotics in Denmark. 
  • Work with current cases and achieve learning of the specific steps and procedures used for the implementation of different projects through the relevant legislation. For example: to be authorized to modify the amount of discharge of treated waste water in a Natura 2000 area, to be authorized to build a windmill farm in a national marine area, a permit to dig a channel in a marine area, and at the same time comply with the water action plan of the area.

Content

The course contains these main academic areas: 
  • The relevant national and European directives, laws, orders, and guidance. 
  • Implementation of legislation in the field of climate adaptation. 
  • Management within the field of climate adaptation 
  • What is the role distribution between utilities, municipalities, ministries, and advisors when approving e.g. new climate adaptation projects, infrastructure projects, lowland projects, afforestation, emission permits, etc.

There will be no preparation in connection with the exam itself.
A question is initially drawn within the syllabus. This question will initially form the basis of the examination. It will be possible to ask questions throughout the syllabus.

Teaching Method

På naturvidenskab er undervisningen tilrettelagt efter trefasemodellen dvs. intro, trænings- og studiefasen.
  • Intro-phase: 40 hours
  • Skills training phase: tutorials: 10 hours with an instructor doing group work and presentations of this

Study phase: Group-work, literature studies, and reading through legislation  

During the lessons, the topics reviewed will subsequently be put into perspective using group assignments (cases), where the participants, in turn, represent The Danish Environmental Protection Agency, municipalities, private companies, and citizen representatives respectively in connection with fictitious cases.

The purpose of the group tasks is to give the participants an in-depth understanding of how the environmental tasks in a country such as Denmark often require cooperation between both key public and private actors.

Furthermore, the purpose is for the students to become aware of the implementation of legislation and management in the field of climate adaptation, including how the division of roles is between utilities, municipalities, ministries, and advisors when approving e.g. new climate adaptation projects, infrastructure projects, lowland projects, afforestation, emission permits, etc.
